General Litigation Team

Who We Are

This team provides advice, assistance and representation in personal injury (excluding clinical negligence), data breach and defamation cases.  The team works in close partnership with the Trusts’ Litigation teams to carefully investigate and resolve cases to minimise impact on the public purse.   All elements of the case, to include general and special damages, CRU, and costs are robustly scrutinised and challenged to achieve the maximum saving possible for our clients.

What We Do

Examples of the type of work carried out include:

  • Providing advice and assistance in relation to relevant legislation and case law including risk assessments, internal investigations, records management and statutory obligations of HSC bodies.
  • Providing advice and assistance in relation to legal liability, valuation and assessment of costs and damages in Employer’s Liability and Occupier’s Liability claims and, where appropriate, negotiating settlement of such claims.
  • Defending Employer’s Liability and Occupier’s Liability cases and providing representation at both County Court and High Court level.

The team is able to use its experience and knowledge of both the HSC needs and the law to work closely with clients to ensure that all advice and representation at court is conducted in a fair, pragmatic, relevant and consistent manner while safeguarding public money.

Training

The General Litigation team provides advice and training in relation to all litigation matters including lessons learned from claims to ensure a safe working environment for both HSC staff and visitors.
